Access to and use of the Website is subject to jurisdictional restrictions. Please review Section 0 of the Terms and Conditions of Use before proceeding.
1. Purpose
These General Contracting Conditions (hereinafter, the "Conditions") govern the contractual relationship between Web3Hispano LLC and any user who purchases any product or service offered through the website shibari-dojo.online (hereinafter, the "Website").
These Conditions are governed by the principles of legality and good faith. By accepting them, the user agrees to use all content and services of the Website without violating applicable law or infringing upon the rights and interests of third parties.
By submitting your purchase or subscription request and checking the corresponding acceptance box, you represent that you have read these Conditions, that you accept them, and that you give your express consent to their content as published at the time of acceptance, committing to their full compliance without reservation.
SHIBARI-DOJO reserves the right to deny access to the Service to any user who breaches these Conditions.

Hereinafter, "SHIBARI-DOJO"
The User / Client:
Accessing the Website and purchasing any of the services and content offered therein grants the person doing so the status of USER (sometimes referred to as "student" or "learner") or, upon completing a purchase or subscription, the status of CLIENT.
The Client is identified through the data provided in the order, enrollment, or subscription form, and is solely responsible for the truthfulness, accuracy, and completeness of such data.
The Client expressly represents and warrants that:
(a) They are at least 18 years of age, or the legal age of majority required by the laws of their jurisdiction, whichever is greater.
(b) They have full legal capacity to enter into binding contracts under the laws of their jurisdiction of residence.
(c) They are acting on their own behalf as a natural person or as a duly authorized representative of a legal entity.
(d) They do not reside in, nor are they accessing the Website from, any Restricted Jurisdiction as defined in Section 0 of the Terms and Conditions of Use.
The User acknowledges and agrees that merely accessing the Website does not, in itself, initiate a commercial relationship with SHIBARI-DOJO. To purchase products or services offered on the Website, the User must use the channels specifically designated for that purpose.
SHIBARI-DOJO may reject purchase requests or cancel client accounts where the data provided is inaccurate, false, or incomplete, without any obligation to provide compensation.
3. Jurisdictional Access Restrictions
These Conditions are governed jointly with the Terms and Conditions of Use of the Website, whose Section 0 establishes the jurisdictional access restrictions applicable to all users and clients. Said restrictions form an integral part of this contract and are incorporated herein by reference for all purposes.
By purchasing any product or service offered on the Website, the Client reiterates and reaffirms the binding declaration set forth in Section 0.3 of the Terms and Conditions of Use. Any purchase made in violation of said restrictions shall be null and void, with no right to any refund, and the Client shall bear exclusive and full responsibility for any legal, fiscal, or other consequences arising from such purchase.
4. Nature of the Service and Place of Performance
4.1 Personalized and non-automated nature of the service
The services offered by SHIBARI-DOJO are strictly personalized in nature. Every training session, one-on-one consultation, workshop, lecture, or other service involves the active and direct participation of a human instructor and is not generated, managed, or delivered in an automated manner.
Supporting educational materials complement the personalized services and do not constitute, by themselves, an independent automated service.
4.2 Place of performance of the service
The services offered by SHIBARI-DOJO are provided through the systems, platforms, and digital infrastructure owned by Web3Hispano LLC, an entity incorporated and domiciled in Albuquerque, State of New Mexico, United States of America.
The online nature of the services means that both the instructor and the Client may connect from different geographic locations during any given session. This does not affect the legal ownership or domicile of the service: the contractual relationship is established, managed, and performed through the systems of Web3Hispano LLC, and it is that entity — and not the instructor or the Client individually — that provides the service as the contracting party.
For all legal, contractual, fiscal, and regulatory purposes, the place of performance of the service is the legal domicile of the operating entity, that is, the State of New Mexico, United States of America. The fact that the Client accesses the service from any other country via digital means does not alter this determination, in the same way that accessing services from international digital platforms does not modify the legal domicile of the provider nor transfer fiscal or regulatory competence over the service received to the Client's jurisdiction.
4.3 Tax implications for the Client
The Client is solely responsible for determining, declaring, and, where applicable, paying any taxes, duties, levies, or fiscal charges that may be applicable in their jurisdiction of residence as a result of contracting services performed from the United States of America.
SHIBARI-DOJO does not act as a withholding agent or tax collector on behalf of any jurisdiction other than the State of New Mexico and the federal tax authorities of the United States of America. Any tax claim, penalty, or demand issued by the authorities of third countries as a result of the Client's purchase of services shall be the exclusive responsibility of the Client.
5. Quality and Availability of Services
SHIBARI-DOJO conducts periodic reviews of the content and information published on the Website. In the event that any inaccuracy or error is detected, we request that it be reported immediately through the Website's contact form, so that it may be promptly corrected.
SHIBARI-DOJO cannot control the use that the User makes of the published information and, therefore, shall not be liable for any damages or losses, direct or indirect, arising from the use of such information.
SHIBARI-DOJO is not responsible for opinions or responses issued by third parties through publications, social media posts, blog comments, or other media, whether published on the Website, on linked websites, or on social networks.
SHIBARI-DOJO carries out ongoing maintenance of the Website to ensure the availability of its services and content. Nonetheless, the User acknowledges that interruptions may occur, whether scheduled to improve Website performance or accidental due to external causes beyond SHIBARI-DOJO's control.
SHIBARI-DOJO reserves the right to make, without prior notice, any modifications, suspensions, cancellations, or restrictions it deems appropriate to the Website, including changes to its design, layout, configuration, content, services offered, and applicable legal conditions.
6. Description of Products and Services
The Website offers live online training sessions (one-on-one consultations, courses, workshops, lectures, exercises, and others), as well as supplementary educational materials in various formats available for student reference.
Communication channels with instructors include Telegram, email, and the channels specifically designed for this purpose within the online platform.
The individual listing for each training session specifies its format, price, required materials, availability of an online study platform, syllabus, access requirements, and any other relevant characteristics.
7. Intellectual and Industrial Property
All elements of the Website — including programming, source code, texts, designs, layout, logos, images, and any other element eligible for protection under intellectual or industrial property law — are the exclusive property of SHIBARI-DOJO or are used under authorization or license from their rights holders, and are protected by applicable intellectual and industrial property laws, including the copyright laws of the United States of America and applicable international treaties.
Except where another applicable license is expressly indicated, SHIBARI-DOJO grants no license or authorization of any kind over its intellectual and industrial property rights, except by express written agreement.
Users may only make private reproductions of the Website's content. Any reproduction, distribution, transformation, or public communication, in whole or in part, of the Website's content or any of its elements, for commercial purposes or for any use beyond private use, even citing the source, is strictly prohibited without the prior express written authorization of SHIBARI-DOJO.
The following are expressly prohibited:
(a) Presenting any page of the Website within the frame of another website using the technique known as framing or any similar technique, without the express written consent of SHIBARI-DOJO.
(b) Embedding images published on the Website in pages or databases not belonging to SHIBARI-DOJO using the technique known as inline linking or any similar technique, without express authorization from SHIBARI-DOJO.
(c) Extracting and using elements of the Website, whether or not such use causes harm to SHIBARI-DOJO.
(d) Establishing hypertext links on third-party websites directed to the Website or any internal page thereof without the express authorization of SHIBARI-DOJO.
Breach of the foregoing shall entitle SHIBARI-DOJO to exercise all legally available remedies to defend its legitimate interests, including the immediate and automatic termination of the contract without prior notice, without prejudice to the Client's liability for infringement of intellectual and industrial property rights.
The Client may not in any way conceal, impair, or obscure the visibility of SHIBARI-DOJO's trademarks, logos, trade name, or other intellectual and industrial property rights on the platform or in the educational content.
8. User Account
A user account is required to access the majority of the content and services offered on the Website.
To create an account, you must have reached the legal age of majority both in your country of origin and in the country from which you are accessing the Website, with a minimum reference age of 18 years. If it is discovered that you have created an account without meeting the required age, the account will be cancelled with no right to restitution or refund of any amounts paid.
When setting up and maintaining your account, you must at all times provide truthful, accurate, and complete information, including a valid email address. In the interest of user and client privacy, a real name is not required; you may complete forms using a nickname or alias.
You must keep your password secure, as you assume full responsibility for all activities carried out through your account, including any damages caused by any person who uses your account without your permission.
If you suspect that someone is using your account fraudulently, please report it through the Website's contact form. We may request additional information to verify your ownership of the account.
If you share your login credentials with another person, you assume full responsibility for everything that occurs on your account. SHIBARI-DOJO will not intervene in disputes between users who have shared their credentials.
You may not transfer your account to another person or use another person's account. In the event of the account holder's death, the account will be closed.
You may cancel your account at any time from the user panel. Voluntary cancellation constitutes a waiver of any right to request refunds or compensation for amounts previously paid.
9. General Subscription Conditions
These Conditions, together with the enrollment form completed upon acceptance, constitute the contract between SHIBARI-DOJO and the Client who makes a purchase or enrollment through the Website.
Upon submitting your request, you must check the acceptance box in the form. By doing so, you represent that you have read these Conditions, that you accept them, and that you give your express consent to their content as published at the time of acceptance.
9.1 Absolute prohibition on shared access ("account pooling")
The practice known as "account pooling" or "joint access" is strictly and absolutely prohibited. This refers to any agreement, whether express or implied, between two or more persons to share, transfer, lend, or otherwise make available to third parties the login credentials for any area of the Website subject to access rights, whereby a single person pays for the service or content and one or more additional persons access it without having individually purchased it.
Licenses provided by SHIBARI-DOJO are strictly personal, individual, and non-transferable. Each license is valid exclusively for the person who has completed and paid for the corresponding subscription or purchase.
Detection of this conduct, or of well-founded indications thereof — including, by way of example, simultaneous logins from different devices or geographic locations inconsistent with a single user, or any usage pattern suggesting credential sharing — shall result immediately and automatically in:
(a) Cancellation of the account holder's account and all associated access and licenses, without prior notice.
(b) Forfeiture of all amounts paid, with no right to any refund.
(c) Permanent prohibition on the creation of new accounts by the account holder.
(d) The initiation of civil and, where applicable, criminal proceedings under applicable law, including a claim for damages arising from unauthorized use of the license.
SHIBARI-DOJO reserves the right to implement technical measures to detect shared access and to require the account holder to demonstrate that their use of the account complies with these Conditions.
9.2 Subscription process
Any user may access the information and pricing for each training session without prior registration. To resolve any questions before subscribing, the Website's contact form may be used, subject to prior acceptance of the Privacy Policy.
To complete a subscription, you must fill out the form with the required fields and select a payment method.
The contract shall be deemed formed upon receipt of the request by SHIBARI-DOJO.
If you have chosen a non-immediate payment method (bank transfer, etc.), you will receive a message with instructions to complete the payment and confirm your subscription, as well as the maximum deadline to do so, after which the subscription will be cancelled.
Throughout the process, any questions may be directed to the Website's contact form.
The language of contract formation and communications with SHIBARI-DOJO shall be Spanish for users accessing through the Spanish-language version of the Website, and English for users accessing through the international version. In the event of any discrepancy between the two versions of these Conditions or any other contractual document, the English version shall prevail.
9.3 Account activation and access to content
Account activation and access to content is NOT immediate. It requires prior payment verification, which may take up to 48 hours for instant payment methods and up to two weeks for international bank transfers. Activations are carried out exclusively during business hours, Monday through Saturday.
Failure to pay the subscription fee or any agreed installment may result in temporary suspension of the student's access to educational content and, where applicable, cancellation of the subscription without right to reimbursement.
9.4 Temporary access license
Upon enrolling in a training session or other content, SHIBARI-DOJO grants you a personal, non-exclusive, and non-transferable license to view it through the Website's services, and for no other purpose.
This license is generally granted for a predefined period expressed in months. SHIBARI-DOJO reserves the right to revoke any access license at any time if it becomes necessary to disable access to the content for legal or content management reasons.
All other uses are expressly prohibited. Without the explicit written permission of an authorized representative of SHIBARI-DOJO, any reproduction, redistribution, transmission, assignment, sale, broadcast, rental, loan, modification, adaptation, editing, creation of derivative works, sublicensing, or any other form of transfer of content — including content accessed through the Website's API — is strictly prohibited.
10. No-Refund Policy
SHIBARI-DOJO does not recognize any right of withdrawal and does not offer refunds or reimbursement of amounts paid under any circumstances.
This policy is based on the nature of the goods and services contracted:
(a) One-on-one consultation services and live training sessions are personalized services whose performance begins at the express request of the Client at the agreed time, thereby fulfilling the object of the contract.
(b) Digital support materials are made available immediately upon confirmation of access and are at the Client's disposal from the moment their account is activated.
(c) The personalized and non-automated nature of the service means that SHIBARI-DOJO reserves time, human resources, and instructional capacity specifically for each Client from the moment the subscription is confirmed.
The no-refund policy applies without exception in all of the following cases, by way of illustration and without limitation:
(a) Voluntary cancellation of the account or subscription by the Client at any time.
(b) Total or partial non-use of contracted content or services, for any reason attributable to the Client.
(c) Account cancellation or access suspension due to breach of these Conditions, including account pooling or credential sharing.
(d) Purchase made in violation of the jurisdictional restrictions set forth in Section 0 of the Terms and Conditions of Use.
(e) The Client's subjective dissatisfaction with the content or service received.
(f) Changes in the Client's personal circumstances occurring after the purchase.
(g) A discrepancy between the Client's expectations and the content actually delivered, provided that said content is consistent with the description published on the Website at the time of purchase.
Notwithstanding the foregoing, SHIBARI-DOJO may, at its sole discretion, make available to users free samples, trial materials, or demonstration access periods. Such options, when available, will be expressly indicated in the description of the corresponding product or service.
11. Pricing and Invoicing
SHIBARI-DOJO reserves the right to modify its prices without prior notice, while respecting the prices applicable to purchases already completed with an active access period.
Prices for services offered on shibari-dojo.online are listed in United States dollars (USD $).
As a measure to protect user identity and privacy, tax information is not collected during the subscription process. If you require documentation for the services contracted, you must submit a request through the Website's contact form providing the necessary details (full name or company name, tax identification number, and billing address).
12. Payment Methods
Upon proceeding to payment, the Client agrees to use a valid and active payment method. The available payment options will be displayed during the subscription process:
- Immediate payment (online): Integrated into the subscription process. Example: PayPal.
- Deferred payment (online or offline): Not directly integrated into the subscription process. Example: bank transfer.
Account activation is not immediate; it is delayed until payment is verified. Activations are carried out exclusively during business hours, Monday through Saturday.
13. Disclaimer of Liability
SHIBARI-DOJO does not control, and cannot control, the use that the user makes of the Service, nor the performance by the user of the exercises, recommendations, and instructions contained therein.
Access to the Service and the implementation of the routines, exercises, and other instructions contained therein is undertaken solely at the user's own risk and responsibility.
The user expressly agrees to hold SHIBARI-DOJO harmless from any injury, harm, loss, discomfort, or other circumstances that may occur during the performance or practice of the routines, exercises, and instructions contained in the Service or in any products purchased.
14. Client Responsibilities
The Client warrants the truthfulness and accuracy of the data provided when completing purchase forms, and undertakes to avoid causing harm to SHIBARI-DOJO as a result of any inaccuracy therein.
You may not access or use the Services, nor create an account, for illegal purposes or in violation of applicable law in your jurisdiction of residence or the jurisdiction from which you are accessing the Website.
Use of the Services and conduct on the platform must comply with the laws applicable in the Client's jurisdiction. The Client is solely responsible for compliance with all laws and regulations applicable in their jurisdiction, including those of a fiscal nature.
Breach of any of these Conditions may result in the cancellation of services by SHIBARI-DOJO without prior notice and without entitling the Client to any compensation.
15. Customer Support
For any inquiry, issue, or claim relating to these services, you may contact SHIBARI-DOJO exclusively through the contact form available on the Website.
Inquiries are handled according to the following criteria:
Training-related inquiries (questions about content, materials, course access, and matters relating to the conduct of training sessions): attended to any day of the week, with a maximum response time of 36 business hours from receipt of the inquiry.
Administrative inquiries (billing, subscriptions, payments, technical issues, and any other management-related matter): attended to Monday through Friday, with a maximum response time of 48 business hours from receipt of the inquiry.
For the purposes of calculating the above deadlines, business hours are those falling within SHIBARI-DOJO's working hours, excluding nighttime hours, public holidays under the calendar of the State of New Mexico, and any service interruption period duly communicated on the Website.
16. Amendments to these Conditions
SHIBARI-DOJO may update these Conditions in the future, as well as the features and functionality of the Service. Changes will be notified by means of a notice in a prominent location on the Website.
If any clause included in these Conditions is declared wholly or partially null, invalid, or unenforceable by a court of competent jurisdiction, such declaration shall only affect the provision in question, and the remainder of these Conditions shall continue in full force and effect.
17. Language and Versions
These Conditions are available in both English and Spanish. In the event of any discrepancy between the two versions, the English version shall prevail, as it reflects the language of the Operator's domicile and the governing law.
18. Governing Law and Jurisdiction
These Conditions shall be governed by and construed exclusively in accordance with the laws of the State of New Mexico and applicable federal laws of the United States of America, without regard to its conflict of laws principles.
For the resolution of any disputes arising from the commercial activity of the Website, the Client and SHIBARI-DOJO agree to submit to the exclusive jurisdiction of the competent courts of Albuquerque, State of New Mexico, United States of America, expressly waiving any other forum or jurisdiction to which they may be entitled by reason of their domicile or place of access to the Website.
By purchasing any product or service from shibari-dojo.online, the Client acknowledges having read, understood, and fully accepted these General Contracting Conditions, the Terms and Conditions of Use of the Website, and the Privacy Policy.
