IMPORTANT NOTICE

These specific conditions supplement the General Contracting Conditions and the Terms and Conditions of Use of the Website, including in particular Section 0 of the latter, regarding jurisdictional access restrictions.

Purchasing this course constitutes acceptance of all applicable contractual documents. In the event of any conflict between these specific conditions and the General Contracting Conditions, these specific conditions shall prevail with respect to this course.


1. Organizing Entity

This course is organized and managed by Web3Hispano LLC (SHIBARI-DOJO), a limited liability company organized under the laws of the State of New Mexico, United States of America, with registered address at 500 4th St NW, Suite 102, PMB 1612, Albuquerque, NM 87102.

The course instructors have demonstrated experience, training, and a verified track record in the practice and teaching of erotic shibari, with recognition — both formal and nominal — within the international community of this discipline.

In areas where officially recognized qualifications exist, the instructors hold such certifications.


2. Subject Matter of the Contract

These conditions govern enrollment in and participation in the Online Erotic Shibari Course (Sekibaku), with the following characteristics:

(a) Format and structure: The course consists of five (5) online sessions in a one-on-one (1:1) format between the enrolled student and the assigned instructor.

(b) Duration of each session: Each session has a duration of ninety (90) to one hundred and twenty (120) minutes.

(c) Frequency: Sessions are non-consecutive. A maximum of one (1) session per enrolled student per calendar month applies.

(d) Session participation format: Although enrollment is strictly individual and the contractual relationship is established exclusively with the person enrolled as the student, sessions require the presence of a practice partner. The enrolled student must be accompanied by a practice partner for the hands-on component of each session.

For the purposes of these conditions, "practice partner" refers exclusively to a person who participates in the practical exercises of the course alongside the enrolled student, in a role equivalent to that of a partner in a contact sport or partner dance. This term does not imply, presuppose, or require any romantic, affective, or legal relationship between the enrolled student and the accompanying person.

The practice partner may:

  • Access the course content and educational materials available on the platform linked to the contracted course.
  • Actively participate in the hands-on components of sessions alongside the enrolled student.
  • Be eligible to receive a certificate of participation or completion, independently of the enrolled student's academic outcome, provided that their participation in the sessions is verifiable.

The practice partner does not acquire the status of student, does not establish any contractual relationship with SHIBARI-DOJO, and has no right to claim services, refunds, or any other benefit. All legal and contractual responsibility rests exclusively and entirely with the enrolled student.


3. Completion Deadlines

3.1 General deadline

The enrolled student has eighteen (18) months from the date of activation of their enrollment to schedule and complete all five sessions comprising the course.

Upon expiration of this period without the student having scheduled or completed any pending sessions, SHIBARI-DOJO shall be released from its obligation to deliver them, with no right to any refund, compensation, or service extension of any kind, in accordance with the no-refund policy set forth in the General Contracting Conditions.

3.2 Installment payment and staged access plans

Under contracting plans with installment payment and staged access to content, the deadline to schedule and complete the sessions corresponding to each module or lesson is reduced to three (3) months per module or lesson, counted from the activation date of each respective module or lesson.

Failure to meet the per-module or per-lesson deadline shall have the same effect as expiration of the general deadline: SHIBARI-DOJO shall be released from its obligation to deliver the pending sessions of the corresponding module, with no right to any refund or compensation.

3.3 Deadline extension due to instructor unavailability

In the event that, for any reason, SHIBARI-DOJO's instructors are unavailable to deliver sessions for a continuous period exceeding one (1) month, such period of unavailability shall be added to the eighteen (18)-month deadline originally granted to the student — or to the applicable per-module deadline in staged-access plans.

The deadline extension shall be communicated to the student through the Website's contact form or by notification in the student's private area of the platform, specifying the new expiration date of the applicable deadline.


4. Account Inactivity

For security purposes, user accounts that remain inactive for a continuous period of six (6) months will be deactivated by SHIBARI-DOJO.

Deactivation of an account due to inactivity does not extinguish any pending contractual obligations and does not give rise to any right to a refund. The student may request reactivation of their account through the Website's contact form, subject to verification by SHIBARI-DOJO.


5. Communications

All communications from the student to SHIBARI-DOJO — including inquiries about content, session scheduling, technical issues, and any other matter — shall be made exclusively through the contact form available on the Website or through the channels provided within the online platform.

For communications from SHIBARI-DOJO to the student — including confirmations, change notifications, deadline alerts, and any other informational or contractual communication — the email address provided by the student at the time of enrollment will be used.

The student is responsible for keeping said address current and active, and for periodically checking their inbox, including the spam or junk mail folder.

Notifications sent to the registered address shall be deemed validly delivered regardless of whether the student reads or acknowledges receipt of them.

The applicable response times are those established in the Customer Support clause of the General Contracting Conditions: a maximum of 36 business hours for training-related inquiries, and a maximum of 48 business hours for administrative inquiries.


6. Jurisdictional Access Restrictions

The purchase of this course is subject to the jurisdictional access restrictions set forth in Section 0 of the Terms and Conditions of Use of the Website, which are incorporated into these specific conditions by reference for all purposes. Any purchase made in violation of said restrictions shall be null and void, with no right to any refund, and the student shall bear sole and exclusive responsibility for any legal consequences arising therefrom.


7. Language, Versions, and Governing Law

These conditions are available in both English and Spanish. In the event of any discrepancy between the two versions, the English version shall prevail.

These specific conditions are governed by and construed in accordance with the laws of the State of New Mexico and applicable federal laws of the United States of America, on the same terms established in the General Contracting Conditions.
